Risk Management
The Risk Management Department operates within the City Attorney's office. This department handles and manages the City's workers' compensation, liability and property insurance. The City of Gallatin is a governmental entity as defined in the Tennessee Governmental Tort Liability Act. The tort liability of municipalities and other local governmental entities is determined under the Tennessee Governmental Tort Liability Act - Tennessee Code Annotated (TCA) Chapter 20. This Act, passed in 1973 by the Tennessee General Assembly, is an attempt to balance the needs of injured persons to recover for injury or damage caused by the negligent acts of a local government and the needs of local governments to provide and of their citizens to receive public services, with unduly burdensome litigation and taxes. One of the most important provisions of the Act is the section that grants absolute immunity to local governments and then creates exceptions to this immunity making them liable for certain actions or inactions, based on negligence.
Not all citizen claims are honored even if correct procedures are followed; there are many circumstances where a claim may be denied.

The Attorney's Office is on the 2nd floor of City Hall. There is a phone outside of the City Council Chambers to ask for admittance to the Attorney's Office.
Not all citizen claims are honored even if correct procedures are followed; there are many circumstances where a claim may be denied.
Steps in filing a claim:
- Fill out the Accident Claim Form in its entirety.
- Deliver the notice of claim form to the Risk Management division in the City Attorney's Office. Claims will not be accepted by any other department.
- Make sure your notice of claim form is filed within 30 days of the incident.
- The City will file a claim with the City's liability carrier once we determine the claim has merit.

Responding to the Notice of Claim
The City of Gallatin will file a claim with the City's liability carrier once the City determines the claim has merit. The claim will be assigned a claims adjuster and you will be contacted within 48 hours of your claim being filed.Filing Claims Without Merit
You should not make a claim that is without merit and not brought or asserted in good faith. The City of Gallatin will report all cases of fraud to the Tennessee Insurance Fraud Division and will seek prosecution to the full extent of the law.-
